1. Acceptance of these Terms
These Terms of Service ("Terms") govern your access to and use of the website at abodemhk.com and any related pages, forms, and online services (collectively, the "Site"), which are operated by Abode Construction Services ("Abode," "we," "us," or "our"). By accessing the Site, submitting a form, or signing up to receive communications from us, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the Site.
2. About Abode
Abode provides residential remodeling, custom building, repair, and related home improvement services in Manhattan, KS and surrounding areas. Descriptions of our services on the Site are for general information only and do not constitute an offer, a guarantee of availability, or a commitment to perform any specific work.
3. Project Request Form, Discovery Call, and Estimates
Submitting a project request form, scheduling a discovery call, or otherwise contacting us does not create a contract for construction services and does not obligate either party to proceed. Any preliminary numbers we share, including any flyover or high-level budget provided after a site visit, are non-binding estimates based on limited information and are subject to change.
A binding agreement for any project is formed only when you and Abode sign a written construction contract or other written agreement signed by an authorized representative of Abode. Those signed agreements, and not these Terms, govern the scope, pricing, schedule, warranties, and other terms of the work we perform for you.
4. Communications Consent
By providing your contact information through the Site or any Abode form, you agree that Abode and its service providers may contact you by phone, email, and text message regarding your inquiry, your project, scheduling, and our services.
If you opt in to receive updates, you agree to receive emails from Abode that may include lead times, project highlights, seasonal remodeling tips, and other company news. You may unsubscribe at any time using the link in any email, or by contacting us at the number below.
Text Messaging (SMS and MMS)
By providing your mobile number and opting in, you consent to receive text messages from Abode related to your project and our services, including appointment scheduling, project updates, reminders, and responses to your questions. The following terms apply:
Message frequency varies based on your project and interactions with us.
Message and data rates may apply, depending on your mobile carrier and plan.
Consent to receive text messages is not a condition of purchasing any product or service from Abode.
You can opt out at any time by replying STOP to any message. After you reply STOP, we will send one confirmation message and will not send further marketing or project texts unless you opt back in.

Carriers are not liable for delayed or undelivered messages.
We do not sell or share your mobile information with third parties or affiliates for their own marketing purposes. Mobile information is used only to provide the communications described above and to support the services you request.
5. Acceptable Use
You agree to use the Site only for lawful purposes. You will not attempt to gain unauthorized access to any part of the Site, interfere with its operation, submit false or misleading information, upload harmful code, or use the Site to harass others or violate any law. We may suspend or restrict access to the Site, or remove any content, at our discretion.
6. Intellectual Property
The content on the Site, including text, photographs, project galleries, graphics, logos, and the Abode name, is owned by Abode or its licensors and is protected by applicable intellectual property laws. You may view and print pages from the Site for your personal, non-commercial use only. You may not copy, reproduce, distribute, or create derivative works from any Site content without our prior written permission.
7. Third-Party Links and Services
The Site may link to or rely on third-party websites and services, including our scheduling, messaging, and form tools. Those third parties are independent, and we do not control and are not responsible for their content, products, or practices. Your use of any third-party service is subject to that party's own terms and privacy policies.
8. Disclaimers
The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Abode disclaims all warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, with respect to the Site and its content. We do not warrant that the Site will be uninterrupted, error free, or free of harmful components, or that any information on the Site is complete, accurate, or current. This section applies to the Site only. Warranties for construction work, if any, are addressed solely in your signed construction contract.
9. Limitation of Liability
To the fullest extent permitted by law, Abode and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages. Our total liability arising out of or related to the Site will not exceed one hundred dollars ($100). Nothing in these Terms limits any rights or remedies provided under a signed construction contract or that cannot be limited under applicable law.
10. Indemnification
You agree to indemnify and hold harmless Abode and its owners, employees, and agents from any claims, damages, losses, and expenses, including reasonable attorney fees, arising out of your use of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.
11. Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. Please review it at abodemhk.com/privacy-policy.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Changes are effective when posted. Your continued use of the Site after changes are posted means you accept the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of Kansas, without regard to its conflict of laws rules. Any dispute arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Riley County, Kansas, and you consent to the jurisdiction of those courts.
